NOTICE
OF PUBLIC HEARING ON A
LOCAL LAW INTRO NO. 1 OF 2009 OF THE TOWN OF GRAND ISLAND,
A LOCAL LAW CREATING A SIX MONTH MORATORIUM ON NEW PONDS AND MINES IN THE TOWN
Notice is hereby given that the Town Board of the Town of Grand Island shall hold a public hearing at 8:00 PM on March 2, 2009 at Town Hall, 2255 Baseline Road, Grand Island, New York, 14072, for the purposes of considering and possibly adopting a local law enacting a six month moratorium on the creation or expansion of Mining/Excavation Overlay zones, approval of site plans for mining or excavating in Mining/Excavation Overlay zones, approval of any subdivision preliminary plat or issuance of any grading permit or building permit proposing the creation of any pond greater than 1/3 of an acre, or expanding an existing pond by more than a 1/3 of an acre. The Town Board may grant waivers, in their sole discretion, where such excavations are necessary for drainage purposes only for subdivisions and site plans. During the moratorium the Town Supervisor shall solicit proposals from one or more geologists or engineers to study the impact of mining on the physical structure of Grand Island, to study and recommend standards for proper drainage of ponds, and to recommend proper construction of ponds addressing safety of uses. At the above time the Board will hear comments on the proposed new law. Copies of the proposed law are available at the Office of the Town Clerk at the above address. At the time and place above, all members of the public shall be heard.
