NOTICE OF PUBLIC HEARING

 

NOTICE IS HEREBY GIVEN that a Public Hearing will be held by the Town Board of the Town of Grand Island, Erie County, New York on

 

Monday, the 7th day of August 2006

 

at 8:00 PM

 

to consider an application by

 

Jerod and Jim Battaglia, 151 South Lane, Grand Island, NY 14072

for a change of classification under the building zone ordinance for property at:

 

2569 Whitehaven Road (owned by Beryl Calabro)Grand Island, New York 14072

 

from M-1 to M-2

for a proposed contractors yard

 

WHICH PREMISES ARE DESCRIBED AS FOLLOWS

 

ALL THAT TRACT OR PARCEL OF LAND, situate in the Town of Grand Island, County of Erie and State of New York, being part of Lot No. 65, described as follows:

BEGINNING at a point in the center line of Whitehaven Road, 513 feet westerly from the southeast corner of said Lot No. 65 as measured along the center line of Whitehaven Road (said point being the southeasterly corner of premises conveyed to Rodney C. Alt and wife by deed recorded in the Erie County Clerk’s Office in liber 7478 of Deeds at page 310); running thence easterly along the center line of Whitehaven Road, 209 feet to the southwesterly line of premises conveyed to George H. Alt Jr. and Carlton W. Alt by deed recorded in Erie County Clerk’s Office in liber 4088 of Deeds page 182; running thence northerly along the westerly line of premises conveyed by said last mentioned deed, 350 feet to the northwesterly corner thereof; running thence easterly along the northerly line of premises conveyed by said  last mentioned deed, 220 feet to the northeasterly corner of premises conveyed by said deed; running thence northerly on a line parallel to the east line of said Lot No. 65, 200 feet to a point; running thence westerly on a line parallel to the center line of Whitehaven Road, 429 feet to the northeasterly corner of premises conveyed to Rodney C. Alt and wife by deed recorded in Erie County Clerk’s Office in Liber 7478 of Deeds page 310; and running thence southerly along the easterly line of premises conveyed to Rodney C. Alt and wife by said last mentioned deed, 550 feet to the point of place of beginning.

                EXCEPTING THEREFROM any part thereof conveyed to the Town of Grand Island by a deed recorded in the Erie County Clerk’s Office in Liber 2564 of Deeds at page 152.

                TOGETHER with the appurtenances to all estate and rights of PARTY OF THE FIRST PART in and to said premises.

                TO HAVE AND TO HOLD the above granted premises unto the said party of second part her heirs and assigns forever.  AND the PARTY OF THE FIRST PART convenants as follows

                FIRST, that the PARTY OF THE FIRST PART is seized of said premises in fee simple, and has good right to convey the same; SECOND, that the PARTY OF THE SECOND PART shall quietly enjoy the said premises; THIRD, that the PARTY OF THE FIRST will forever warrant the title to said premises; FOURTH, that this conveyance is made subject to the trust fund provisions of the Lien Law Section 13 and FIFTH, that this conveyance is not of all or substantially all of the property of the party of the first part and is made in the regular course of business actually conducted by the party of the first part
