ORDER CALLING PUBLIC

HEARING


 

                                                                                   

 

WHEREAS, a petition has been filed with the Town Clerk, signed and acknowledged in the manner required by law by a sufficient number of property owners, together with a map, plan and report for the creation of the Hidden Oaks Subdivision - Phase 3 Lighting District No. 49; and

WHEREAS, the boundaries of the proposed district are as follows:

 

ALL THAT TRACT OR PARCEL OF LAND situate in the Town of Grand Island, County of Erie, State of New York, more particularly described as follows:

 

ALL THAT TRACT OR PARCEL OF LAND situate in the Town of Grand Island, County of Erie, State of New York being part of Lot 16, Township 12, Range 9 bounded and described as follows:

 

Beginning at the point of intersection of the north line of Lot 16, Township 12, Range 9 with the west line of Sub Lot 31 as shown on a map of Countryside Manor, Section 3, filed in the Erie County Clerk’s Office under Map Cover 2288;

 

THENCE: S-00°-00’-18”-W, along the west line of Lot 31, a distance of 184.98 feet to a point on the north line of Oakridge Road;

 

THENCE: Easterly, along the northerly line of Oakridge Road, as shown on said Map Cover 2288, on a curve to the left having a radius of 581.18 feet, an arc distance of 5.00 feet to a point;

 

THENCE: S-00°-00’-21”-W, along the westerly line of Oakridge Road, as shown on said Map Cover 2288, a distance of 70.00 feet to the southerly line thereof;

THENCE: N-89°-59’-42”-W, a distance of 150.00 feet to a point;

 

THENCE: S-00°-00’-18”-W, a distance of 480.72 to a northerly line of Hidden Oaks Subdivision, Phase Two;

 

THENCE: N-89°-59’-42”-W, along said northerly line, a distance of 250.00 feet to a point on the westerly line of Oakridge Road as shown on a map of Hidden Oaks Subdivision, Phase Two;

 

THENCE: Southwesterly, along the northwesterly line of Oakridge Road, on a curve to the right having a radius of 165.00 feet, an arc distance of 197.77 feet to the southeasterly corner of Sub Lot 21 as shown on said map of Hidden Oaks, Phase Two;

 

THENCE: N-21°-19’-08”-W, along the easterly line of said Lot 21, a distance of 198.16 feet to the northeasterly corner thereof;

 

THENCE: N-66°-14’-19”-W, along the northerly line of said Lot 21, a distance of 68.77 feet to the southeasterly corner of Sub Lot 12 as shown on a map of Hidden Oaks, Phase One (Map Cover 2972);

 

THENCE: N-13°-15’-28”-E, along the easterly line of said Sub Lot 12, a distance of 135.92 feet to the northeasterly corner thereof;

 

THENCE: S-89°-06’-52”-W, along the northerly line of said Sub Lot 12, a distance of 201.86 feet to the southeasterly corner of Sub Lot 11 as shown on said map of Hidden Oaks, Phase One;

 

THENCE: N-22°-37’-30”-E, along the easterly line of said Sub Lot 11, a distance of 287.75 feet to the southeasterly corner of Sub Lot 10 as shown on said map of Hidden Oaks, Phase One;

 

THENCE: N-00°-00’-18”-E, along the easterly line of said Lot 10, a distance of 444.88 feet to the northeasterly corner thereof being on the northerly line of Lot 16, Township 12, Range 9;

 

THENCE: N-89°-50’-18”-E, along the northerly line of said Lot 16, a distance of 845.00 feet to the POINT OR PLACE OF BEGINNING containing 13.96 acres be the same more or less.

 

WHEREAS, the improvements proposed consist of an electric street lighting system serving said Hidden Oaks Subdivision - Phase 3, and

WHEREAS, the estimated annual expense of supplying of said electrical street lighting is $1,105.89, which said expense shall be levied and collected from the several lots and parcels of land within said Lighting District,

NOW, THEREFORE, be it ORDERED, that a meeting of the Town Board of the Town of Grand Island will be held at the Town Hall, 2255 Baseline Road, Grand Island, New York, on August 21, 2006 at 8:00 p.m. on said day, to consider creation of said district including the environmental significance thereof and to hear all persons interested in the subject thereof, concerning the same, and for such other and further action on the part of said Town Board, with relation to the premises; and

BE IT FURTHER ORDERED, that the map, plan and report referred to herein, including the explanation of how the cost to the typical property was determined, may be reviewed at the office f the Town Clerk, 2255 Baseline Road, Grand Island, New York, during normal business hours; and

BE IT FURTHER ORDERED, that the Town Clerk shall publish a copy of this Order at least  once in the official newspaper of the Town, the first publication of which is to be not less than ten nor more than twenty days before the date set herein for the public hearing, and shall also cause a copy of this Order to be posted on the sign-board of the Town maintained pursuant to Town Law  '30(6), not less than ten nor more than twenty days before the date set herein for the public hearing; and

BE IT FURTHER ORDERED, that the Town Clerk shall file a certified copy of this Order with the Office of the State Comptroller, on or about the date of publication of this Order.
