WHEREAS, a petition has been filed with the Town Clerk, signed and acknowledged in the manner required by law by a sufficient number of property owners, together with a map, plan and report for the creation of the Hidden Oaks Subdivision - Phase 2 Lighting District No. 48; and

WHEREAS, the boundaries of the proposed district are as follows:

 

ALL THAT TRACT OR PARCEL OF LAND situate in the Town of Grand Island, County of Erie, State of New York, more particularly described as follows:

 

ALL THAT TRACT OR PARCEL OF LAND situate in the Town of Grand Island, County of Erie, State of New York, being part of Lot 16, Township 12, Range 9 of the Holland Land Survey (so-called) bounded and described as follows:

 

BEGINNING at the point of intersection of the northerly line of Oakridge Road (70.35 feet wide) with the easterly line of Sublot 19 as shown on a subdivision map of Hidden Oaks Phase One filed in the Erie County Clerk’s Office under cover 2972;

 

THENCE: N-00°-00’-18”-E, along said easterly line of Sublot 19 a distance of 189.88 feet to the northeasterly corner of Sublot 19;

 

THENCE: N-86°-17’-46”-E, along the northerly line of proposed Sublot 20 a distance of 90.19 feet to the northwest corner of proposed Sublot 21;

THENCE: N-89°-46’-48”-E, along the northerly line of proposed Sublot 47 a distance of 150.00 feet to the west line of Countryside Lane as shown on a subdivision map of Countyside Map Section 3 filed in the Erie County Clerk’s Office under cover 2288;

 

THENCE: S-00°-00’-18”-W, along said west line a distance of 70.00 feet to the southwest corner thereof;

 

THENCE: S-89°-46’-48”-W, along a line of proposed Sublot 47 a distance of 47.48 feet to a point;

 

THENCE: S-00°-00’-18”-W, along an easterly line of proposed Sublot 47 a distance of 150.00 feet to a point;

 

THENCE: S-89°-46’-48”-W, along the southerly line of proposed Sublots 47 and 48 a distance of 109.49 feet;

 

THENCE: Southwesterly along the proposed southerly line of Sublot 48 on a curve to the right having a radius of 60.00 feet an arc distance of 64.80 feet to a point of tangency;

 

THENCE: S-89°-46’-48”-W, along the proposed southerly line of Sublot 48 a distance of 3.79 feet to the easterly line of a portion of existing 20.00 feet wide public drainage easement as shown on Map Cover 2288;

 

THENCE: S-00°-25’-42”-E, along the easterly line of aforementioned easement a distance of 308.00 feet to a point on the north line of Fix Road;

 

THENCE: S-89°-46’-48”-W, along the north line of Fix Road a distance of 20.00 feet to a point on the westerly line of aforementioned drainage easement.

 

THENCE: N-00°-25’-42”-W, along the westerly line of aforementioned easement a distance of 289.72 feet to a point on the proposed southerly line of Sublot 48;

 

THENCE: S-89°-46’-48”-W, along the southerly line of proposed Sublots 48, 49, 50, 51, 52 and 53 a distance of 558.49 feet to the southeasterly corner of Sublot 54 as shown on the aforementioned map cover 2972;

 

THENCE: N-00°-25’-42”-W, along the easterly line of Sublot 54 a distance of 207.09 feet a point on the southerly line of Oakridge Road;

 

THENCE: Easterly along Oakridge Road on a curve to the right having a radius of 665.00 feet, an arc distance of 63.60 feet to a point;

 

THENCE: N-00°-00’-18”-E, across Oakridge Road a distance of 70.35 feet to THE POINT OF BEGINNING, containing 6.24 acres be the same more or less.

 


WHEREAS, the improvements proposed consist of an electric street lighting system serving said Hidden Oaks Subdivision - Phase 2, and

WHEREAS, the estimated annual expense of supplying of said electrical street lighting is $1,105.89, which said expense shall be levied and collected from the several lots and parcels of land within said Lighting District,

NOW, THEREFORE, be it ORDERED, that a meeting of the Town Board of the Town of Grand Island will be held at the Town Hall, 2255 Baseline Road, Grand Island, New York, on August 21, 2006 at 8:00 p.m. on said day, to consider creation of said district including the environmental significance thereof and to hear all persons interested in the subject thereof, concerning the same, and for such other and further action on the part of said Town Board, with relation to the premises; and

BE IT FURTHER ORDERED, that the map, plan and report referred to herein, including the explanation of how the cost to the typical property was determined, may be reviewed at the office of the Town Clerk, 2255 Baseline Road, Grand Island, New York, during normal business hours; and

BE IT FURTHER ORDERED, that the Town Clerk shall publish a copy of this Order at least  once in the official newspaper of the Town, the first publication of which is to be not less than ten nor more than twenty days before the date set herein for the public hearing, and shall also cause a copy of this Order to be posted on the sign-board of the Town maintained pursuant to Town Law  '30(6), not less than ten nor more than twenty days before the date set herein for the public hearing; and

BE IT FURTHER ORDERED, that the Town Clerk shall file a certified copy of this Order with the Office of the State Comptroller, on or about the date of publication of this Order.
