PROPOSED LOCAL LAW INTRO NO. 12

REZONING A PORTION OF THE PROPERTY OF

NIAGARA DEVELOPMENT GROUP, LLC

ON EAST RIVER ROAD

NOTICE IS HEREBY GIVEN that the Town Board of the Town of Grand Island will hold a public hearing at 8:00 p.m., on December 18, 2006, in Town Hall, 2255 Baseline Road, Grand Island, New York to consider and possibly adopt a Local Law rezoning from R-2 to R-1D property owned by Niagara Development Group, LLC on East River Road, more specifically described as follows:

All that Tract or Parcel of land situate in the Town of Grand Island, County of Erie, State of New York, being part of lots 51 north and 51 south and being more particularly described

as follows;

Beginning at a point on the northern boundary of East River Road ( a 99 foot wide Right-of-way ) said point being 295.38 feet easterly measured from the southeast corner of Sublot 151 as shown on a map titled East Riverside Woods “ The Overlook “ , section 6B and filed in the Erie County Clerks office under cover 2970, measured along the northern boundary of East River Road, said point also being on the east line of lands now or formerly of Ronald Case Filed in the Erie County Clerks Office in Liber 9642 Of deeds at page 658 .

Running thence northwesterly at an angle of 90 degrees with the northern boundary of East River Road and along the easterly line of Liber 9642 At page 658 , 160.0 feet to a point.

Running thence northeasterly at an interior angle of 90 degrees, 240.0 feet to a point.

Running thence northeasterly at an exterior angle 179 degrees 52 minutes 49 seconds, 80.00 feet to a point.

Running thence northeasterly at an exterior angle of 175 degrees 23 minutes 47 seconds, 80.27 feet to a point.

Running thence northeasterly at an exterior angle of 173 degrees 03 minutes 20 seconds, 81.69 feet to a point.

Running thence northeasterly at an exterior angle of 172 degrees 52 minutes 26 seconds, 84.51 feet to a point.

Running thence southeasterly at an interior angle of 71 degrees 12 minutes 22 seconds, 160.0 feet to a point on the northern boundary of East River Road.

Running thence southwesterly along the northern boundary of East River Road, on an arc to the right, having a radius of 668.54 feet, 261.58 feet to a point of tangent.

Continuing thence southwesterly along the northern boundary of East River Road, 305.05 feet to the point or place of beginning.

Said Tract or Parcel of land containing 2.06 acres of land being the same more or less.

At the time and place stated above, all interested members of the public shall be heard.
