MINUTES: JULY 13, 2009

Chairman Sturniolo opened the meeting at 7:00 P.M.

1.  FROM:            Town Engineer

     RE:              HUGILL STORAGE – 2761 BEDELL RD.

                        SITE PLAN – PHASE VI BUILDING CONSTRUCTION  

 

Mike Lydle appeared representing Jack Hugill, requesting Site Plan Approval for the construction of a 100’ x 30’ metal storage building at 2761 Bedell Rd.

Mr. Lydle explained that they have revised their previously approved Site Plan.  They exceed the 30’ stream setback.  He has revised

calculations, taking into consideration the outdoor and indoor storage.  The green space is greater than the required 10%.

Mr. Starzynski questioned the 30’ stream setback.  According to the zoning map, Class C requires 50’.

 Mr. Westfall stated that Engineering, after reviewing all the facts and inspecting the site, may possibly grant a waiver for the setback.  

 Mr. Hugill stated that they have never had a water problem.  All the buildings stay dry.  Every building has the same elevation.  If the proposed building floods, all the rest of the buildings would flood.   

 It was moved by Starzynski – Cashimere to APPROVE the site plan,

conditioned upon the Engineering Department’s review and analysis of the 30’ setback versus the 50’ and the granting of a waiver.

2.  FROM:            Town Engineer

     RE:              RIVER OAKS MARINA – 101 WHITEHAVEN RD.

                        SITE PLAN – WAREHOUSE/SHOWROOM/SERVICE

                        REVISED JULY 2009

 

Kristin Savard, P.E., Advanced Design Group, appeared representing River Oaks Marina, requesting Site Plan Approval for a warehouse, showroom and service building to be constructed at 101 Whitehaven Rd.

She explained that they were granted approval of a previous site plan contingent on the granting of an 8’ variance for building setback for the

northwest corner of the building.  The variance was not granted and the application was withdrawn.

 They have revised the plan, downsizing the building so that they will not need a variance.  She changed the building footprint, tables and schedules

accordingly on the site plan.

3.  FROM:            Town Engineer

     RE:              JOHN YENSAN – 6TH STREET AT 1ST AND 2ND AVE.

                        SITE PLAN – MINE FOR 2.7 ACRE POND

 

Kristin Savard, P.E., Advanced Design Group appeared representing John Yensan, with a site plan for a single family dwelling and a 2.7 acre pond to be constructed on a 33 acre parcel on 6th Street at 1st and 2nd Ave.

 A wetland survey has been completed.  They will not disturb the jurisdictional wetlands.  They are working with the DEC on the mining permit.

They have made application for the site plan and zoning overlay.  They are working on the DEC application and SEQR has been started.

 This property is adjacent to the campground with a 7 acre lake.  The owners of the campground are working with Mr. Yensan.  He may use the haul roads that the campground used.  There would be an increase in duration for hauling but not frequency.

 Approximately 42 thousand cubic yards of soil will be hauled away.  Six to 7 thousand cubic yards will stay on the site.  The front of the property is very low.  Mr. Yensan will use some of the soil to fill this area.  

There will be a berm and landscaping and a buffer to the campground.

There was a discussion regarding the construction of the pond and not building the house.  Mr. Starzynski expressed his concern on this matter. He stated that this is a mining operation.  The creation of a single family home is incidental.  Once the pond is created, it is there forever.  Will it be a stagnant hole in the ground?  He has a problem with the mining overlay zoning on a residential parcel.  The property next door is zoned commercial recreation.  He questioned what the Town’s position is on ponds since there were discussions on a moratorium.

Ms. Savard stated that the proposed house will be Mr. Yensan’s.  He is talking about putting the field in now for the septic system.

It was noted that the property is owned by two people.

The DEC recommended pond standards including side slopes that will discourage the cat tails and other vegetation from growing.  The pond will

be 12’ deep and will be stocked.  Mr. Yensan may put in a sandy beach in the corner near the house.

 

Ms. Savard stated that there are pockets of this parcel that can be   developed.  From a cost standpoint it is an undevelopable property.

Mr. Yensan is taking the front 6 to 7 acres and making it buildable with a house and a couple of out buildings.

 

It was moved by Sturniolo – Czesak to recommend APPROVAL of the overlay district based on the site layout.  We recommend that the owner post a bond or escrow until a certificate of occupancy is issued on the house to cover the possibility that the pond is built and the house is not.

With the DEC being the environmental lead, the permit issued from them should include the Town’s rules and regulations.

Since we know there are more pond applications coming in, we are asking for clarification on the Town’s stance on ponds.  We need some guidance.

 There was some discussion on the size of ponds.  A 1/3 of an acre pond is not always sustainable.  It sometimes ends up more of a hindrance.

 

4.  FROM:            Town Engineer

     RE:              RANSOM VILLAGE SUBDIVISION – SECTION 4E (23 LOTS)

                        FINAL PLAT APPROVAL

 

                        The Final Plat for Section 4E of Ransom Village Subdivision was reviewed.  

                        Mr. Westfall explained that this was approved a number of years ago as two sections at one time.  Only one was built.

                         Lot dimensions, 80’ x 160’, and layout have not changed.  Section 4E conforms with the character of the existing neighborhood.

                         It was moved by Starzynski – Czesak to recommend APPROVAL of the Final Plat for Section 4E of Ransom Village Subdivision as submitted.
