PLANNING BOARD MEETING

 

MINUTES: MARCH 8, 2010

 

MEMBERS PRESENT:            Duchscherer, Ferrentino, Greco, Starzynski, Worrall

 

OTHERS PRESENT:            Councilman Roesch, Assistant Municipal Engineer Robert Westfall and Those Listed Herein.

 

Mr. Greco opened the meeting at 7:00 P.M.

 

MINUTES:     Planning Board Meeting – February 8, 2010

 

                         It was moved by Duchscherer – Worrall to APPROVE the minutes as

                         submitted.

1.  FROM:            Town Engineer

     RE:              WATERFORD PARK SUBDIVISION - PHASE 3

FINAL PLAT APPROVAL - 23 LOTS

 

James Churchill, of Scheid Architectural, appeared at the March 8th Planning Board Meeting representing Thomas Giambra for Final Plat Approval of Waterford Park Subdivision - Phase 3 (23 lots).  There are no changes to the lot configuration or count from the originally approved project.   

 

Mr. Westfall reiterated there have been no changes, they have the design plans and that Engineering has no issues.  He has recommended moving forward with the project. 

 

It was moved by Starzynski – Worrall to recommend APPROVAL of Final Plat to Waterford Park Subdivision - Phase 3 (23 lots).

2.  FROM:            Town Engineer

     RE:              COUNTRY CLUB COTTAGES SUBDIVISION - PHASE 1

                        FINAL PLAT APPROVAL - 26 LOTS

 

Al Hopkins, Metzger Civil Engineering, PLLC, appeared at the March 8th Planning Board Meeting representing John W. Stickl Construction for Final Plat Approval of Country Club Cottages Subdivision - Phase 1 (26 lots), presented the previous plan and maps from the Preliminary Plat.  He stated that there have been no changes and they have the approval of the Engineering Department and the Health Department.  Mr. Hopkins asked for the recommendation of Final Plat Approval.

 

Mr. Westfall stated that there have been no changes to the lot configuration or count from the approved Preliminary Plat.  He recommended moving forward with the project.   

 

Mr. Greco asked if the creek runs through the subdivision and about the elevation and drainage.  Mr. Hopkins said that the ditches will be cleaned to improve the drainage and a permit is pending with the U.S.A.C.O.E.     

 

It was moved by Duchscherer – Starzynski to recommend APPROVAL of Final Plat to Country Club Cottages Subdivision - Phase 1 (26 lots).

3.  FROM:            Town Engineer

     RE:              BRANCHES OF NIAGARA CAMPGROUND & RESORT

                        f.k.a. -             WHITEHAVEN ROAD CAMPGROUND

                        REQUEST TO REZONE A PORTION OF PROPERTY AND

                        CREATE A RESIDENTIAL LOT - WHITEHAVEN RD.

                        CR TO R1-A

 

Mr. Westfall noted that there no representatives present at the meeting and proceed to review the request to rezone a portion of the existing campground property from CR to R1-A, and a request for exception to subdivision regulations to break it off the existing campground parcel, creating a residential building lot fronting on Whitehaven Road. 

The rezoning will allow a portion of SBL #36.00-1-1.11 be rezoned from CR to R1-A to permit an exception to subdivision regulations to create a single residential building lot with frontage on Whitehaven Road.  The possibility of a caretaker house for the campground has been relocated to  within the campground allowing the campground to split and sell a piece of their property.   

 

Mr. Westfall explained that the Planning Board also needs to evaluate  whether recreation fees will be required.    

 

It was moved by Duchscherer - Starzynski to recommend APPROVAL to rezone a portion of SBL #36.00-1-1.11 from CR to R1-A to Branches of Niagara Campground & Resort (f.k.a. - Whitehaven Road Campground). 

 

It was moved by Duchscherer - Starzynski to recommend that an Exception to the Subdivision Regulations be GRANTED to Branches of Niagara Campground & Resort (f.k.a. - Whitehaven Road Campground) to create one lot for a residential building lot fronting on Whitehaven Road.

 

It was moved by Starzynski - Ferrentino to recommend APPROVAL to  assess a $500 recreation fee to Branches of Niagara Campground & Resort (f.k.a. - Whitehaven Road Campground.

4.  FROM:            Town Engineer

     RE:              TERRY MANNING - 1143 MEADOW LN.

                        REQUEST FOR AN EXCEPTION TO SUBDIVISION

                        REGULATIONS - CREATE AN 89.6’ X 183’ PARCEL

 

Mr. Westfall presented the request from Terry Manning for an exception to the subdivision regulations at 1143 Meadow Lane to split out an 89.6’ X 183’ parcel from the current 189.6’ X 183’ parcel occupied by his home.  The resulting lots meet the bulk zoning regulations, including side yard setback for the existing home and the proposed property split line. 

 

Mr. Westfall explained that this same request was approved many years ago and the property owner never filed the lot and that the approval has expired.  He recommended approval and that a finding regarding the recreation fee needs to be made. 

 

It was discussed that the project does not enhance recreation in the area and determined to assess the fee to the project.

 

It was moved by Starzynski - Ferrentino to recommend that an Exception to the Subdivision Regulations be GRANTED to Terry Manning to split out an 89.6’ X 183’ parcel from the current 189.6’ X 183’ parcel at 1143 Meadow Lane.

 

It was moved by Starzynski - Ferrentino to recommend APPROVAL to assess a $500 recreation fee to Terry Manning - 1143 Meadow Lane.

Mr. Westfall asked that at the applicant’s request on March 8th, that the  Concept Development Plan - River Oaks - for a Proposed PDD for Whitehaven Farms be tabled until next months meeting.  

 

Al Hopkins, Metzger Civil Engineering, PLLC, who was in attendance agreed to remain after the meeting to participate in an informal discussion with the Planning Board members.        

 

It was moved by Ferrentino – Worrall to TABLE the Whitehaven Farms - River Oaks - Concept Development Plan - Proposed PDD Currently Zoned R-2 until the April 12th Planning Board meeting.
