1. VERIZON CELL TOWER SITE PLAN – REVISED - VETERANS PARK
SANDY BEACH CELL SITE
Gregory Nearpass, Attorney with Nixon Peabody and Brett Morgan, of Verizon
Wireless appeared with a revised Site Plan for the location of the cell tower in Veterans
Park.

Mr. Nearpass stated that on February 19, 2009, the Planning Board approved the Sandy Beach Cell Site. Their plan now is to move the location of the cell site outside of the park on adjacent property owned by the Town.
During a title review of the original location, they found a deed restriction that restricts the use of the property for park land only. The parcel was donated by the Funk family for a park. Instead of trying to get a release, they feel the adjacent Town owned property will be a good location and it is not burdened by that restriction. Granson Geis donated this land, which is contiguous to the park area. They will enter into a lease agreement with the Town.
The revised location will bring the tower farther away from nearby homes, about six and one-half times the height of the 125’ tower. There is approximately 795’ to the closest house. Mr. Nearpass noted that many towers are built so that they collapse within themselves, equal to one half of the height.
They are currently showing approximately 82’ from Veterans Park. If they can move it further to the east, to approximately 125’, they would not need an area variance of approximately 43’. There are, however, pockets of wetlands that they will have to avoid. The proposed location will not interfere with a future parking lot proposed by the Town.
Mr. Sturniolo stated that he likes this location better than the previously approved location. He has been concerned with the out buildings. Setting it further back helps.
Landscaping has been added. The tree committee will look at the plan. Mr. Nearpass stated that whatever the committee feels is appropriate, they will plant.
Mr. Worrall asked if there are any public hearings on this location. Mr. Roesch responded that there will be a public hearing at a later date. If a formal application is submitted to the Town Board at the February meeting, a public hearing will probably be scheduled for the first week in March.
They have been working on the Sandy Beach site since October of 2007. The Presbyterian Church and Garden Parkway sites were not well received. Due to many objections by residents in the Sandy Beach area, that brought them to the Town property. However, because of the coverage, it is still called the Sandy Beach Cell Site. There has been more public participation then they have ever seen.
This discussion was for information only. No action taken at this time. A formal application will be made for the next meeting.

hopefully be available by the middle of next month.
